Dear Sir,
I the undersigned had purchased a mobile phone of the make of Samsung Galaxy from the Classic Mobile. I had purchased the said mobile at a price of Rs. 19900/- on 9th June 2011 date. A copy of the said bill is enclosed hereto.
I was at my office. Situated at Pune on 19th June 2011 . I had kept the aforesaid mobile on the table. At about 16:30 time, the mobile which was kept on the table, suddenly exploded and made a huge sound as if a bomb had exploded. Several parts of the mobile phone came to be scattered I had a providential escape and consider myself lucky that at the time it exploded; I was neither using nor sitting close to the mobile.
I showed the said phone to my dealer but received a rude response. I had called Shri Vaibhav Pathare and Shri Shoaib Shaikh, and having examined the said mobile phone, did not expressed any regret, leave aside considering replacing the instrument and / or compensating the loss caused to me.
I am aghast by the conduct and behaviour of Samsung, claiming to believe in ethics and customer friendly Instead of admitting the defect and deficiency in service, and ensuring that no such calamity occurs in future, the response of Samsung has been most pathetic and condemnable. I shudder when I reminisce what would have been happen to me if, I was actually using the mobile at the time when it exploded. It could have proved fatal.
The instrument manufactured by Samsung was deadly and detrimental to my health and safety. The said instrument is manufactured and sold by Samsung for being used as a cell phone being a mobile phone it is either kept in the pocket or held in hand or near ear while talking. It is thus expected to be safe and harmless. Under these circumstances the instrument cannot be expected to be exploded.
I hereby call upon you to replace the phone immediately and pay damages of Rs. 50,000/- for loss caused to me failing which I shall initiate proceedings both Civil and Criminal against you which please note.
I regret to place on record that you had manufactured and given me a mobile phone instrument which is nothing but an Instrument of Death. The manner it exploded would have caused certain death or serious impairment, if I had held and used at that time. This act of manufacturing instrument which causes death or serious ailment is an offence
