I am sorry to mention that none of countrymen have given any comments on the sufferings of Shri Kishore Chandra Dash, At.Khallikote,Karan Street, Dist. Ganjam whose pension claim has been rejected by the Government of India. Ministry of Home Affairs. I want an answer from the legal persons on the following point.That practice was followed till 2002 that a freedom fighter if produced a Co-Prisoner Certificate from a co-prisoners even if he was imprisoned for less than one year and his case has been recommended by the INA Advisory Committee. After 2002, the Ministry decided to sanction pension on the basis of CPC given by a Co-prisoner who was imprisoned for at least one year since INA Committees were not in existence then. Shri Dash had submitted CPC from one Basu Swain who was imprisoned for 11 months and was also a Central Freedom Pension Holder.His case was recommended by the Capt.S.S.Yadav, Member, INA Advisory Committee. But his case has been rejected in 2005 citing the provision of schemes followed in 2005. In my view, the applications received in 1995 which was supported by CPC and recommended by INA Advisory Committee shall be given pension since the procedures were followed like this at the relevant time. Applications received after 2002 when the Ministry decided to dispose the applications as per the scheme has to be disposed off under the Scheme. So the learned people of India including the learned Advocates are requested if the decision of Government of India rejecting his application is not a sheer injustice to him. I am a reader of Hindu. The Hindu, Chennai edition had published an article on the sufferings of Late Laxmi Indira Panda,ex-INA Veteran of Koraput of Odisha as to how the officials of Ministry of Home Affairs had harassed her in sanction of freedom fighters pension. Only after kind intervention of President Smt. Prativa Devi Singh Patil, her Secretary wrote a letter to Home Secretary, after that freedom fighters pension was sanctioned to her. But due to her bad luck, she was at comma state then at AIIMS,New Delhi and passed away without knowing that her contribution was recognized by the Country.Similar a case in Odisha, Shri Kishore Chandra Dash, s/o late Purusottam Dash, At.PO. Khallikote, Karan Street, Ganjam, Odisha who took part in the freedom struggle as INA solider and was imprisoned in Burma during 1945-46. He had applied for freedom fighters pension on 28.3.1973 but his case was not considered. In 1995 his case was considered and referred to Capt. S.S.Yadav, Member, INA Advisory to authenticate the documents and offer his views. On 13.10.1998, he categorically authenticated the documents produced by Shri Dash and recommended for sanction of pension w.e.f 24.4.1995. After receipt of recommendation on 13.10.1998, the file remained unattended. On 24.5.2005, the Joint Secretary of the Home Ministry rejected the claim that prevailing rule in 2005 does not permit the sanction of pension. It is to mention the Under Secretary/Deputy Secretary had clearly mentioned that had the file of Shri Dash been processed at the relevant time, he would have been safely sanctioned pension. Now I want to ask a question to the officers if Shri Dash is responsible for not processing the file in 1998 further. Against the inflicted him, Shri Dash is submitting successive representation to the President of India, Vice President of India Prime Minister of India, Home Minister, Secretary, Home, Smt. Sonia Gandhi,Chairperson, UPA, Smt. Sushma Swaraj, Leader of Opposition, Lok Sabha for kind intervention. Information collected under RTI Act reveals that none of the representations were submitted to any authority higher than Joint Secretary against whose arbitrary decision, Shri Dash is protesting. In the meantime, as desired by President of India, Smt. Prativa Devi Singh Patil, the Chief Secretary, Odisha had conducted an inquiry through Collector, Ganjam and the inquiry report of Collector, Ganjam was forwarded to Home Miinistry by the Finance Department of Government of Odisha by Speed Post. But the Ministry is denying to receive the same. Hon'ble Governor, Odisha has written to Home Minister on 1.6.2012 but the Ministry is denying to have received the letter. It is revealed under RTI Act. Information under RTI Act also reveals that Under Secretary/ Deputy Secretary of Home Ministry have observed that at the relevant time (1998) pension were used to be sanctioned on the basis of INA Advisory. Had the case of Shri Dash been processed further, pension would have been safely sanctioned. Shri Dash asks question to Home Ministry if he is responsible for not processing the file after 13.10.1998 after receipt of recommendation of Capt. S.S.Yadav.He has on 24.1.2013 has submitted representation to Shri Rahul Gandhi, Vice-President, Indian National Congress, Shri Sushilkumar Shinde, Home Minister,Secretary, Home for kind intervention. Shri Das is at 86 years age may pass any time. At this critical juncture, he sought the help of media to help him in fighting aginst this injustice. His Mob Phone No.9439420272.
